The following terms and conditions (these “Terms”) apply to your purchase of products and services (each, a “Product” and collectively, the “Products”) from Y.Youngs Medicine Mart Inc. and Y.Youngs Medicine Mart (Main) Inc. (“YYoung”) through

The Website is a platform in which you may purchase Ecommerce online product goods, third party suppliers such as doctors (“Third Party Suppliers”) and other health care practitioners can sell health care packages for private care consultation. You may also order prescription medication through the Website for pick up at your desired YYoung pharmacy location or for delivery. The Website also provides the community with health awareness education.
These Terms must be read with this Website’s general Terms and Use of Website and the terms specific to the Products purchased by you.
By clicking “I Agree”, you acknowledge that you have read, accepted and agreed to be bound by these Terms.
These Terms are subject to modification by YYoung without prior written notice at any time, in YYoung’s sole discretion. The version of these Terms applicable to your purchase will be the version in effect on the day you submit the applicable order to YYoung.
1. PRICE AND PAYMENT TERMS
The services our Website offers include making online bookings, ordering healthcare packages from Third Party Suppliers, ordering product goods, and using our prescription delivery service.
The total price and all other related charges for Products will be set out under “Your Order” on the Website. The total purchase price will provide a breakdown of and taxes, which will be added to the purchase price for the Products. The Third Party Suppliers may add additional fees to the total purchase price. Once you submit your order, you will receive a receipt of payment. If you have set up an account (“Account”) with us on the Website, confirmation of your order will be sent to the email address you provided in your Account.
Any price offers or advertisements on the Website will be valid for the period stated on the offer or advertisement, except that YYoung reserves the right to reject any sale for any reason, including without limitation for a misprint in the price offer or advertisement. YYoung is not responsible for price offers offered by Third Party Suppliers on the Website.
2. PURCHASING PRESCRIPTION MEDICATION
You may purchase prescription medication through the Website. YYoung reserves the right to request that you provide a valid original prescription from a doctor duly registered and in good standing with the College of Physicians and Surgeons of British Columbia.
You may submit your order online and choose which YYoung pharmacy you would like to pick up your prescription medication or for delivery. Please click here for a list of our locations. The Website will set out the delivery charge associated to the delivery of your prescription medication to your chosen location. You will be asked to pay at the time you pick up your prescription medication at one of our pharmacies.
3. RETURNS AND EXCHANGES
There are no refunds or exchanges for Products ordered on the Website. If you would like to refund or exchange a Product you purchased from a Third Party Supplier through our Website, you will have to contact the Third Party Suppliers directly and process refunds or exchanges directly through the Third Party Suppliers, subject to the refund or exchange policy of the Third Party Supplier.
4. DISCLAIMER
The Website is a platform that allows for Ecommerce sale of product goods, and medical practitioners to advertise and sell their products, such as health care packages, on our Website. You understand that:
- we make no representations or warranties as to the quality, condition, fitness, or suitability of the Products. Neither YYoung, its parent, subsidiaries, affiliates, or any of their respective employees, agents, officers, directors (“Company Parties”) make any warranty, condition, quality, fitness, or suitability of any kind, whether express or implied, regarding the Products sold or advertised on the Website and YYoung specifically disclaims the implied warranties and conditions of merchantable quality, fitness for a particular purpose, to the maximum extent permitted by law;
- we make no guarantee that Products appearing on the Website will be available, Products may change or be discontinued at any time;
- we make no representation that the Product you ordered will match the illustrations, photography or description on the Website; and
- warranties may also be provided by third party suppliers, YYoung is not liable or responsible for such warranties.
5. LIMITATION OF LIABILITY
Company Parties will not be liable for any loss suffered by you, including but not limited to personal injury, indirect, consequential, special or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party. Without limiting the generality of the foregoing, the Company Parties are not liable to you for any loss suffered by you as a result of you using the Products provided by Third Party Suppliers, including but not limited to supplements provided by medical practitioners or prescription medication manufactured by drug manufacturers. In any case, if Company Parties are held liable to you for whatever reason, Company Parties are not liable or responsible for any amount of damages beyond the aggregate dollar amount paid by you for the purchase of the Products giving rise to the liability.
6. ENTIRE AGREEMENT
These Terms together with the Terms of Use of Website, and all other notices, policies, and statements contained on this Website (all as may be amended by YYoung from time to time without prior notice) constitute the entire agreement between you and YYoung. These Terms may not be altered, supplemented, or amended by the use of any other documents. Any attempt to alter, supplement or amend this document or to enter an order for Products that are subject to additional or altered terms and conditions will be null and void. These Terms may be changed by YYoung at any time, in its sole discretion without prior notice, with respect to any future sales or transactions with you.
7. PRIVACY
You have read YYoung’s Privacy and Data Handling Policy, the terms of which appear on this Website and are incorporated into these Terms. You agree that the terms of this policy are reasonable. You consent to the collection, use and disclosure of your personal information by YYoung or its agents or representatives in accordance with the terms of and for the purposes set forth in the Privacy Policy.
8. GOVERNING LAW
These Terms will be governed by and construed in accordance with laws of the Province of British Columbia and of Canada, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of the Province of British Columbia, Canada.
9. GENERAL
The failure of YYoung to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent non-performance of any such term or condition by you. The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms. If any provision of these Terms will be ruled unenforceable, then the remainder will be enforced to the extent permissible. This Website is not intended for use by children under the age of 19. Use of this Website is void where prohibited by applicable law.
